COURT UPHOLDS $2,513,000 VERDICT AGAINST BNSF

After a five-day trial, a Chariton County, Missouri jury returned a verdict for an injured locomotive engineer for $2,513,000.00 in damages caused by BNSF’s negligence.  The case was brought under the Federal Employers Liability Act (FELA).  The jury also found that BNSF’s violation of the Locomotive Inspection Act and a Federal Railroad Administration regulation related to locomotive safety contributed to Plaintiff’s injuries.  The Court entered a Judgment against BNSF in the full amount of the verdict.

BNSF filed a motion requesting a new trial and for judgment notwithstanding the verdict.  After full briefing and oral argument the trial Court denied BNSF’s motion in all respects and upheld the Judgment in the amount of $2,513,000.00.
