WORKERS’ COMPENSATION
If you have been injured on the job in Missouri, you may be entitled to workers’ compensation benefits. Missouri, like all other states, has created a system to compensate employees for on-the-job injuries. Missouri’s workers’ compensation system provides benefits for injuries arising out of, and in the course of, employment. All claims are administered by the Missouri Department of Labor, through the Division of Workers’ Compensation.
Workers’ Compensation Benefits:
Missouri’s workers’ compensation system may provide benefits including medical treatment to cure and relieve the effects of a compensable injury, temporary total disability payments for the time the injured worker is unable to work, permanent partial disability benefits for injuries that are not completely resolved, permanent total disability benefits for injured employees who are never able to return to the open labor market, disfigurement benefits for employees who have lost limbs or have permanent scarring, and death benefits for families who have lost a loved one due to an on the job accident.
Do you need a lawyer?
With the possible exception of claims involving minor injuries, you should be aware of both the advantages of consulting an attorney to help you with your workers’ compensation claim and the pitfalls of not seeking help.
Missouri laws related to the workplace and workers’ compensation are extensive and complex. Understanding your rights under workers’ compensation laws is critical to the successful outcome of your claim. Additionally, the future impact of your injury and claim must be carefully evaluated. For example, if you will require future medical treatment, payment of expenses for that treatment must be considered before your case is settled.
You need someone to fight for you. It is important to understand that while a knowledgeable Administrative Law Judge will administer your claim, it is not the judge’s job to act as an advocate for you. Your employer will be represented by its insurance company’s lawyer whose goal it is to minimize costs, not to help you. Having an experienced attorney on your side will ensure that your interests are represented and that you receive full and fair compensation.
At Groves | Powers L.L.C, we can help guide you through the legal maze so that you receive the maximum compensation to which you are entitled under the law. Our fees are contingent upon your recovery, which means you will not be charged a fee until we secure a successful resolution of your claim for you.
We will also evaluate your case to determine whether a party other than your employer may be liable for injuries arising out of your workplace injury. Examples of those claims include:
- Product Liability
- Auto Collisions
- Premises Liability
- Co-employee Liability
In workers’ compensation claims, like all injury claims, you have a limited time to file your case. Waiting too long to contact an attorney may jeopardize your ability to recover compensation for your injuries.
